Time for a reality check: the rumor originated in a British tabloid. Reality check #2: Sean Penn would never in a million years do the film. Not because of Jack Nicholson, although that's a good reason, but because he'd simply never do such a brashly commercialistic film that requires him to run around looking like a clown. And Nolan can't be courting anyone until he actually signs on for the sequel, which he hasn't done yet.
That said, Penn might not be bad for the role ...
